Abstract: Starting from an overview of the context and overall message of the Papal Address on November 25, 2017, this article analyzes the Pope’s clarifications of the processus brevior in particular. The reference made to the personal and exclusive exercise of the judicial power of the Bishop in the briefer process requires the implementation of one of the reform’s key principles (the central role of the Bishop in the administration of matrimonial justice). Without prejudice to the value of an authentic “viva voce” interpretation of the text, given their content and import the Pope’s clarifications (expressed in nine points) ought to be taken into account. The pontifical address represents a further contribution to the path of the reform that neither alters nor overturns the legal text itself nor the principles of the system. Ultimately, feedback regarding these interpretive papal clarifications depends on effective collaboration from the episcopacy, ongoing academic study, and coordination at an institutional level.; La presente contribución, partiendo del contexto y de la articulación global del Discurso del Papa del 25 de noviembre de 2017, analiza principalmente las aclaraciones pontificias relativas al <i>processus brevior</i>. La llamada al <i>ejercicio personal y exclusivo de la potestad judiciaria del Obispo en el processus brevior</i> pretende estimular la apropiada puesta en práctica de un principio cardinal de la reforma (la efectiva centralidad del Obispo en la administración de la justicia matrimonial). Quedando intacto el valor de una suerte de interpretación auténtica del texto hecha “<i>a viva voz</i>”, las indicaciones pontificias (expresadas en 9 puntos) deben ser tenidas en consideración según su tenor y contenido. La intervención pontificia constituye una nueva contribución en el camino de la reforma que no altera ni trastorna el texto legal ni los principios del sistema. Abstract: Civil and canonical codes have inherited the capacity-to-act system based on the definition of legal age set out in Roman law. However, a significant part of (both civil and canonical) jurisprudence alters its legal status by interpreting the rule of age of majority in a positivist sense, as a dividing line between those with capacity and those without. This approach sets up a rigid and unrealistic system in which the ‘validity’ of natural capacity is excluded once the rule of legal civil or canonical age of majority has been established. ‘Naturalistic’ perspectives have emerged in response, proposing a direct recognition of natural or tiered capacity in multiple age brackets. Apart from these opposing positions, and in line with the classical legal tradition, the legal age of majority may be read as a presumption of <i>iuris tantum</i>, thus allowing any person with natural capacity to act, with legal efficacy, in a viable and certain way.; Los distintos códigos civiles y canónicos heredan el sistema de capacidad de obrar basado en la edad legal iniciado en el Derecho romano, pero una parte considerable de la doctrina cambia su naturaleza jurídica al interpretar la norma de la mayoría de edad en sentido positivista como frontera que separa a las personas en capaces e incapaces. Esto implica un sistema rígido y poco realista en el que se descarta la ‘vigencia’ de la capacidad natural una vez promulgada la norma de la mayoría de edad legal civil o canónica. Abstract: The term “plurality” (variety, multiplicity) is often more apt than the term “pluralism” to describe the doctrinal and liturgical diversity within the Church. But in certain ecclesiological dimensions there is true pluralism, such as pluralism of the lay faithful in temporal affairs or charismatic pluralism. Charismatic pluralism has been the focus of considerable academic and pastoral attention since the Second Vatican Council. At the same time, however, the concept of charism has become broader, more fluid and more difficult to define. With regard to the complementary (never antagonistic) relationship between charism and institution, the function of canon law is, firstly, to foster spaces of freedom to exercise charisms; secondly, to establish rules and regulations governing reasonable practices in this regard; and finally, to distinguish between authentic charisms and fabricated movements.; El término “pluralidad” (variedad, multiplicidad) es ordinariamente más adecuado que el de “pluralismo” para calificar la diversidad doctrinal y litúrgica en el seno de la Iglesia. Pero existe verdadero pluralismo en determinadas dimensiones eclesiológicas como el pluralismo de los fieles laicos en asuntos temporales o el pluralismo carismático. El pluralismo carismático ha tenido un repunte muy considerable en la consideración académica y pastoral a partir del Concilio Vaticano II. Pero simultáneamente el concepto de carisma se ha hecho más amplio, más fluido y más problemático en orden a su identificación. Various constitutional documents were in force during that historical period: the 1834 Royal Statute, the 1837 Constitution and the 1845 Constitution. Two further projects did not come into effect: the 1852 Constitution and the 1856 Constitution.
