Resumen
ABSTRACT: This paper analyses the Inter-American Court of Human Rights’ Case Law on art. 10, about Freedom of Expression, with a particular focus: the influence received from the European Court of Human Rights’ Case Law. Throughout the review of the 8 cases – Ivcher Bronstein v. Perú (2001), Olmedo Bustos an others v. Chile (2001), Maritza Urrutia v. Guatemala (2003), Myrna Mack v. Guatemala (2003), Canese v. Paraguay (2004), Herrera Ulloa v. Costa Rica (2004), Palamara Iribarne v. Chile (2005) and Claude Reyes and others v. Chile (200)- it shows on one hand the diversity of circumstances and facts respect to the jurisprudence of the European Court, and on the other hand, the implementation of the main argumentation on Freedom of Expression from the resolutions of this European institution. It is too early to talk about a consolidate jurisprudence from the Inter-American Court of Human Rights, but this institution is working with a strong determination to guarantee the right to Freedom of Expression. KEY WORDS: Freedom of Expression. Jurisprudence of the Inter-American Court of Human Rights. Jurisprudence of the European Court of Human Rights.
