El contenido y la determinación del "ius connubii" y sus manifestaciones en el sistema matrimonial canónico vigente

Abstract

En este artículo se intenta hacer una explicación del matrimonio y del 'ius connubii' a partir del realismo jurídico, porque el matrimonio, antes que sistema jurídico de normas, es una realidad que exige un sistema jurídico que lo reconozca, regule, proteja y promueva. Desde esta óptica se puede comprender el porqué del sistema jurídico matrimonial. Ante la ruptura de la unidad jurídica y cultural de Occidente, es necesario hacer un esfuerzo para reencontrar las raíces de nuestro sistema matrimonial, que no es una superestructura que constriñe dentro de unos márgenes angostos una ilimitada libertad del hombre en lo que se refiere a su decisión sobre el uso de la sexualidad, sino un sistema que, atesorando de las enseñanzas de siglos, trata de dar respuesta a las exigencias del 'ius connubii' como derecho fundamental de la persona y del fiel fundado en la complementariedad entre la masculinidad y la feminidad. ------ This article intends to make an explanation about marriage and 'ius connubii' starting from the juridical realism, because marriage, before being a juridical system of norms, is a reality which demands a juridical system which may recognize, regulate, protect and promote it. From this viewpoint, the reason for the matrimonial juridical system can be understood. Faced with the rupture of the juridical and cultural unity of the West, it is necessary to make an effort to reencounter the roots of our matrimonial system, which is not a superstructure which constrains within some narrow margins an unlimited liberty of the person regarding his or her decision about the use of sexuality, but a system which, enriching itself of the centuries-old teachings, deals with providing answers to the demands of 'ius connubii' as a fundamental right to the person and Christ's faithful based on the complementarity of masculinity and feminity.
