Antecedentes del patrimonio estable (c. 1291 del CIC de 1983)

Abstract

El patrimonio estable, al menos desde el punto de vista formal, es una novedad introducida en el CIC de 1983. Sus antecedentes están relacionados con el régimen de protección del patrimonio eclesiástico frente a determinadas enajenaciones. El autor ha estudiado fundamentalmente el periodo que va desde la Constitución Apostólica 'Ambitiosae' de 1468 hasta el CIC de 1917, centrando su trabajo en la primera codificación. Los documentos del 'Archivo Secreto Vaticano' han arrojado mucha luz sobre el proceso de codificación de los cánones relativos a la materia. El autor también ha estudiado la doctrina, tanto anterior como posterior al CIC de 1917, que ha sido una de las protagonistas en la introducción de la figura en el derecho canónico. El dinero y su papel dentro del patrimonio eclesiástico constituyen una de las principales vías de renovación del régimen de la enajenación.

ENGLISH: Stable Patrimony, at least from the formal point of view, is a newness introduced in the 1983 CIC. Its antecedents are related to the regime of protection of the ecclesiastical patrimony from certain alienations. The author has studied fundamentally the period that goes from the Apostolic Constitution 'Ambitiosae' of 1468 to the Code od 1917, centering his work in the first codification. The documents of the 'Vatican Secret Archives' have thrown much light on the process of codification of the canons related to the subject. The author has also studied the doctrine, both previous and subsequent to the 1917 CIC, that has been one of the protagonists in the introduction of the figure in canon law. Money and its role within the ecclesiastical patrimony constitute one of the main routes of renovation of the regime of alienation.
