La defensa y promoción de la libertad religiosa por la Administración norteamericana (2000-2007). Parte II: United States Department of State (USDS)

Abstract

La tutela de la libertad religiosa en el derecho norteamericano había sido presentada, hasta este momento, casi exclusivamente en sede jurisprudencial y legislativa. Era necesario ofrecer un estudio de los esfuerzos realizados por la administración norteamericana en la protección de la libertad religiosa a través de los Departamentos de Justicia y de Estado. La primera parte de nuestro estudio se centró en la lucha interna por el efectivo ejercicio de esta libertad a través del Departamento de Justicia. Sirviéndose de varios órganos y proyectos, este Departamento luchó contra la discriminación religiosa en diversos sectores (educación, trabajo, vivienda, acceso a instalaciones abiertas al público y de titularidad pública, regulación del suelo, y derechos de los internos en ciertas instituciones) y persiguió las actividades criminales contra personas y bienes religiosos. La segunda parte de nuestro análisis presenta el trabajo realizado por el Departamento de Estado y su Oficina sobre libertad religiosa en el orden internacional creada por la ley 1998 ('International Religious Freedom Act'). Sus informes anuales suponen un instrumento de gran valor a fin de evaluar el estado de libertad religiosa en el mundo. El estudio evidencia que la libertad religiosa sigue necesitando protección en el orden internacional, que la administración norteamericana -consciente de esta realidad- ha respondido con mayor o menor eficacia y que su reacción se basa en la consideración positiva de la libertad religiosa como la primera de las libertades. En definitiva, es innegable que la administración norteamericana, en el tiempo estudiado, parece firmemente comprometida en asegurar el pacífico disfrute del derecho de libertad religiosa, dentro y fuera de sus fronteras. Si interviene fuera es porque dentro no escatima esfuerzos en esa dirección. ------ The commentaries in Europe about Religious Liberty in the United States are principally jurisprudential and legislative studies. Then, it was necessary to offer an analysis of the work realized by the American Administration: United States Department of Justice (USDOJ) and United States Department of State (USDS). The first part of this article studies the domestic efforts in the effective exercise of religious freedom. In order to protect this liberty, the USDOJ has taken several initiatives against religious discrimination in some areas (education, employment, housing, credit, public facilities, public accommodations, zoning laws, religious rights of persons in state institutions) and has acted against federal crime suffered by a person or a place of worship based on religion. In this second part, the article presents the international work of the USDS and its Office on International Religious Freedom (OIRF) created by the International Religious Freedom Act (IRFA) of 1998. The Annual Reports on International Religious Freedom are a great instrument for evaluating the religious freedom status around the world. Our study concludes with these affirmations: religious freedom needs protection at home and abroad; the USDOJ-USDS answer is not as bad as their enemies believe; and the American Administration supports a positive lecture of the religious freedom that reveals its condition as the first freedom. In conclusion, both Departments seem firmly decided to protect this first freedom, and if the USDS acts abroad it's because the USDOJ is active at home.
