La enseñanza de la religión católica en Andorra: la constitucionalidad del Acuerdo del Principado de Andorra y la Santa Sede

Abstract

El artículo analiza la cuestión de constitucionalidad planteada respecto al Concordato de Andorra de 2008. La reclamación argumentaba la falta de legitimidad del art. XI.3 de dicho Tratado internacional, que establecía la oferta obligatoria de la enseñanza religiosa católica por parte de todos los centros educativos andorranos. Las razones aportadas por los reclamantes son tanto la libertad religiosa de los alumnos y padres, como la libertad de enseñanza de los centros educativos laicos, y la aconfesionalidad del Estado. El Tribunal Constitucional de Andorra resuelve en un Auto interpretativo la cuestión, afirmando la constitucionalidad de dicho artículo, aunque exceptuando su aplicabilidad en el caso de los colegios cuyo ideario choque frontalmente con dicha enseñanza.

This article analyses the question of constitutionality raised by the Concordat of Andorra of 2008. The appeal contended that article XI.3 of this international treaty lacked legitimacy, since it establishes that Catholic religious education must be offered at all educational institutions in Andorra. The grounds put forward by the claimants were the religious freedom of students and parents, the freedom of education of secular educational institutions, and the non-denominational nature of the State. The Constitutional Court of Andorra resolved the issue by affirming the constitutionality of the article, but ruled that schools whose mission statement was in direct opposition to religious education were exempted from applying it.
