dc.description.abstract | Para conocer la incidencia del Derecho divino en Derecho administrativo canónico, resulta de utilidad el estudio de las decisiones de la segunda Sección del Tribunal de la Signatura Apostólica, que juzga cuando un acto administrativo canónico contraviene la ley eclesial, sea una ley divina, natural o positiva, o sea eclesiástica. En la apreciación de las lesiones del Derecho divino, destaca la jurisprudencia acerca de instrumentos procesales que derivan del Derecho divino natural (por ejemplo, derecho de defensa) en relación con la dignidad de la persona. En el artículo se consideran además diversas decisiones de la Signatura que tienen en cuenta otros aspectos del Derecho divino natural y positivo. Se concluye afirmando que la publicación de las decisiones del Supremo Tribunal de la Signatura Apostólica debe ser vista como un servicio que ayuda a la necesaria adecuación entre Derecho divino y Derecho humano en el sistema jurídico de la Iglesia. | es_ES |
dc.description.abstract | To know the incidence of divine law in canonical administrative law, the study of the decisions of the second section of the Tribunal of the Apostolic Signatura proves to be useful, those that judge when a canonical administrative act contradicts the ecclesial law, be it divine law, natural or positive, or ecclesiastical. In the appreciation of the lesions of divine law, the jurisprudence on procedural instruments which derive from natural divine law (for example, right of defense) in relation to the dignity of the person finds a significant place. In this article, diverse decisions of the Signatura which take into account other aspects of divine natural and positive law are also considered. It is concluded by affirming that the publication of the decisions of the Supreme Tribunal of the Apostolic Signatura should be seen as a service that helps the necessary leveling off between divine law and human law in the juridic system of the Church. | es_ES |
