Alcance de la oferta educativa en una entidad confesional. La escuela católica

Abstract

La formación integral del hombre y la participación en la misión de la Iglesia configuran el alcance educativo de la escuela católica. En el ámbito jurídico civil, estos dos principios toman carta de naturaleza en la figura del carácter propio. Sin embargo, la actual imprecisión normativa en torno a dicho carácter propio puede llegar a convertirse en una potencial amenaza para el alcance educativo de la es- cuela católica. En este sentido, el artículo 52 de la LODE se revela, con su imprecisa invocación a la libertad de conciencia, como crucial en este intento limitador. La colisión de esta libertad con el carácter propio se manifiesta especialmente en la clase de religión, las celebraciones litúrgicas y la presencia de alumnos de otras confesiones y remitidos por las Comisiones de Garantías. La resolución de dicho conflicto habrá de resolverse teniendo presente las vinculaciones que el carácter propio presenta con la libertad de enseñanza y de religión.

The integral formation of man and the participation in the mission of the Church configure the educational scope of the Catholic school. In the civil juridic aspect, these two principles assume a nature in form of a mission statement. However, the actual normative imprecision on the said mis- sion statement can reach to converting itself in a potential threat to the educational scope of the Catholic school. In this sense, the article 52 of the LODE reveals itself, with its imprecise invocation of freedom of conscience, as crucial in this limiting attempt. The collision of this freedom with the mis- sion statement is manifested particularly in the religion class, the liturgical celebrations and the presence of students of other confessions and forwarded by the Commissions of Guarantees. The resolution of the said conflict must be done bearing in mind the connections that its mission statement presents with the freedom of education and religion.
