La inmatriculación de fincas de la Iglesia católica por medio de certificación diocesana

Abstract

El artículo 206 de la Ley Hipotecaria establece un procedimiento rápido, barato y sencillo para la inmatriculación de fincas de la Iglesia católica en el Registro de la Propiedad. Sin embargo, se han generado dudas acerca de la compatibilidad de este precepto con los artículos 14 y 16 de la Constitución. El presente estudio parte de los cánones de interpretación de las normas recogidos en el artículo 3.1 del Código civil para defender la plena constitucionalidad del artículo 206 de la Ley Hipotecaria. Asimismo, se analizan algunas cuestiones prácticas que se pueden suscitar con ocasión de la inmatriculación de una finca eclesiástica.

Article 206 of the Spanish Mortgage Act provides a fast, cheap and easy way for the first registration of immovable properties belonging to the Catholic Church. However, a number of doubts have been raised concerning the compatibility of this provision with Articles 14 and 16 of the Spanish Constitution. This paper starts from the canons of construction of the rules contained in Article 3.1 of the Spanish Civil Code in order to argue the full constitutionality of Article 206 of the Mortgage Act; some practical issues that may arise when the Catholic Church registers an immovable property are also discussed.
