Virtualidad de la motivación religiosa en la pérdida de idoneidad del profesorado de religión católica

Abstract

La situación laboral del profesorado de Religión católica tiene un carácter especial por el papel que ejerce la Iglesia a la hora de proponer su contratación. El concepto de idoneidad es determinante en esta propuesta, pero también cuando se dan circunstancias que considera determinantes para la pérdida de aquella y la llevan a revocar su propuesta. El Tribunal Constitucional ha avalado la legalidad de la decisión de la Iglesia, siempre y cuando la justifique, sus motivos sean religiosos y no suponga una vulneración de los derechos fundamentales de los profesores. Sin embargo, una reciente sentencia ha rechazado la revocación de la idoneidad aunque existía una motivación de carácter religioso. El Tribunal Constitucional ha menospreciado la trascendencia de las circunstancias que movieron a a tomar aquella decisión, realizando así un papel que no le corresponde conforme al principio de neutralidad.

Because of the role played by the Catholic Church when they are hired, the employment status of Catholic religion teachers has a distinctive nature. Competence is a key concept in this regard, and likewise when the Church regards the defining circumstances of such competence as having been lost, thus revoking the original decision to hire. The legality of the Church’s decision in this context has been validated by the Constitutional Court, on condition that the reasons are exclusively religious and that the fundamental rights of teachers are not undermined. However, a recent court decision has rejected any revision of teacher competence, even on religious grounds. The Constitutional Court paid little heed to the significance of the conditions taken into consideration by the Church, thus infringing the Church’s prerogative by ignoring the principle of neutrality.
