Derecho y economía en la tradición tomista

Abstract

La actual crisis económica mundial refleja la ruina de los métodos cuantitativos imperantes en las ciencias sociales, inspiradores del Derecho y Economía vigente. Es una visión originada en los años sesenta de la pasada centuria. Este artículo remonta los orígenes de esa disciplina científica a varios siglos antes y expone el método utilizado para aquel entonces. De este modo formula una visión del Derecho y Economía cimentada en el estudio de la realidad social y en un método diferente a los cuantitativos, que distinga a las ciencias sociales, cuyo objeto es la acción humana.

The current world economic crisis reflects the ruin of the quantitative methods reigning in the social sciences that inspire the prevalent vision of the Law and Economics. It’s a vision originated in the 1960s of the last century. This paper returns to origins of that scientific discipline several centuries ago and exposes the method used. Thus formulates a vision of Law and Economics based on the study of social reality, and in a different method to quantitative that identifies social sciences whose mater object is the human action.
