La perspectiva del derecho y la justicia intraeclesial ante los desafíos actuales sobre el matrimonio y la familia

Abstract

La consideración del derecho como objeto de la justicia ayuda a descubrir que el matrimonio y la familia constituyen un bien jurídico eclesial, ya que existen en este ámbito derechos de las personas, de las familias y de la Iglesia. La relación con la misericordia se ilumina también, descubriendo que ella mueve ante todo a obras en el respeto de los derechos y a ir generosamente más allá en el amor pero sin ceder nunca a la injusticia. En este marco se indican cuatro desafíos actuales en los que está implicada la justicia intraeclesial: la conservación y difusión del Evangelio de la familia en la Iglesia y en el mundo; la promoción de la familia como iglesia doméstica; la existencia del matrimonio, fundamento de la familia; y la comunión eclesial de los fieles casados.

The consideration of right (that which is just) as the object of justice reveals that marriage and the family are an ecclesial juridical goog, given the fact that there exist rights belonging to persons, families and the Church. The relation between justice and mercy is also clarified, with the primary role of the latter being to respect the rights of others and the generously going beyond out of love, but without ever yielding to injustice. Inm this framework, ther are four current challenges regarding justice within the Church which stand out: the conservation and spreading of the Gospel of the family in the Church and throughout the world; promoting the family as a domestic church; the existence of marriage as the foundation of the family; and ecclesial communion among the married faithful.
