dc.description.abstract | A response issued by the Apostolic Signatura recalled that expertise is essential to declaring the nullity of marriage due to incapacity to consent, unless it seems as though this may serve no purpose (canons 1095 and 1680). When he is unable to examine the subject (often because the latter refuses), the expert is to base his opinion on the information, especially the medical facts, recorded in the trial transcript. Obtaining such data without or against the will of the party involved is problematic. Civil case law in requires the provision of such data when rights of the same rank as privacy are in dispute. Although its value as evidence is objectively more limited than that of ordinary expertise, in practice it depends on reliable data set out in the court records. Since the areas of competence of judge and expert are different, the interaction between them –ne cessarily critical on the judge’s part– ought to seek out common ground, in which the knowledge of each is congruent with the other’s. | es_ES |
dc.description.abstract | Una Respuesta de la Signatura Apostólica recordaba que la pericia es medio de prueba imprescindible para declarar la nulidad por incapacidad, salvo que aparezca evidentemente inútil (cc. 1095 y 1680). Cuando el perito no pueda examinar al sujeto (frecuentemente porque este se niega) basará su dictamen en los datos, sobre todo de carácter médico, que encuentre en los autos. La obtención de este tipo de datos sin o contra el querer del interesado es problemática; en Italia existe jurisprudencia civil que ordena facilitar esos datos cuando está en juego la defensa de derechos del mismo rango que la intimidad. Aunque su valor como medio de prueba sea objetivamente más limitado que el de la pericia ordinaria, en la práctica depende de los datos fiables que resulten del sumario. Siendo distintos los ámbitos de competencia científica de juez y perito, el diálogo entre ambos –necesariamente crítico por parte del juez–deberá buscar un terreno común, donde cabe bien el conocimiento que cada uno posea de la materia del otro. | es_ES |
