dc.description.abstract | Among the many cases commenced against the Catholic Church for alleged sexual abuse of minors by priests and members of religious orders, a number of cases have been taken directly against the Holy See and the Pope themselves. Both former and latter have used the defence afforded by sovereign immunity and immunity of the head of state. To be accepted, as it has been in fact the case, the sovereign immunity of the Holy See must be shown, among other factors, to rest on proof that the priests and bishops of the United States cannot be regarded as “employees” of the Holy See for the purposes of the Foreign Sovereign Immunities Act. This in turn prompts the question of the nature of the relationship –under canon law and in practice– between the central government of the Church and priests and bishops in their dioceses. | es_ES |
dc.description.abstract | Entre los muchos casos iniciados contra la Iglesia Católica por supuestos abusos sexuales a menores cometidos por sacerdotes y miembros de órdenes religiosas, algunos casos han estado dirigidos contra la Santa Sede y el Papa mismos. Estos últimos han interpuesto, como defensa, la inmunidad soberana y la inmunidad del jefe del estado. Para ser aceptada, como lo ha sido, la inmunidad soberana de la Santa Sede debe descansar, entre otras cosas, sobre la prueba de que los sacerdotes y obispos de los Estados Unidos no pueden ser considerados “empleados” de la Santa Sede, a los efectos de la Foreign Sovereign Immunities Act, lo que a su vez plantea la cuestión de cuál es la relación, conforme a Derecho canónico y en la práctica, entre el Gobierno de la Iglesia y los sacerdotes y obispos en sus diócesis. | es_ES |
