Cuestiones canónicas sobre los delitos más graves contra el sexto mandamiento del Decálogo

Abstract

El presente trabajo da una visión general de la regulación de los delitos contra el sexto mandamiento en el código vigente de 1983 y en el anterior código de 1917, así como en la Instrucción Crimen Sollicitationis de 1962. Una parte muy importante del estudio está dedicada a los delitos más graves reservados a la CDF, tal y como están contemplados en el M. P. Sacramentorum sanctitatis tutela, en su versión reformada de 2010. Se tratan los elementos canónicos más importantes de estos delitos, subrayando algunos aspectos que pueden afectar a la imputabilidad (ingesta de alcohol, drogas, alteraciones psicosexuales, etc.) y, consecuentemente, a la punibilidad. Se insiste en la necesaria prudencia para valorar la gravedad real del caso concreto, con todas sus circunstancias, para determinar el castigo más justo.

This article offers an overview of the rules regarding violations of the Sixth Commandment set out in the CIC 1983, as well as in the 1917 Code of Canon Law and the 1962 Instruction Crimen Sollicitationis. A significant part of the article addresses the most serious violations of the Sixth Commandment reserved to the Congregation for the Doctrine of the Faith in accordance with the motu proprio Sacramentorum sanctitatis tutela (revised in 2010). The most important canonical aspects of these crimes are explored, with a particular focus on factors that may affect imputability (the consumption of alcohol or drugs, psychosexual disorders, etc.) and, as a consequence, the punishment of such violations. The need for prudence in assessing the real seriousness of each case, given all the specific circumstances, so as to establish the fairest punishment, is underscored.
