El problema de la participación de los laicos en la potestad de régimen. Dos vías de solución

Abstract

Al tratar de la participación de los laicos en la potestad de régimen, se discute el alcance de algunos textos del Concilio Vaticano II y de la legislación canónica vigente. Según la distinción tradicional entre potestas ordinis y potestas iurisdictionis, aquí se proponen dos distinciones que permiten reconocer las posibilidades que el derecho actual abre a los que no han recibido el orden sagrado. La primera es la distinción entre oficios capitales y auxiliares; la segunda se refiere a las diferencias entre el ejercicio individual y colegial de la potestad.

This article explores the scope of a number of Vatican II texts and current canon law dealing with the participation of the laity in the power of governance. The author sets out two distinctions in light of the traditional doctrine of the difference between potestas ordinis and potestas iurisdictionis. This approach enables an understanding of the possibilities afforded by the current law to those who have not received Holy Orders. The first is the distinction between capital and auxiliary offices; the second refers to the differences between the individual and collegial exercise of jurisdiction.
