La continuidad del magisterio sobre libertad religiosa: La interpretación de Dignitatis humanae en su contexto histórico

Abstract

El autor estudia la continuidad entre la doctrina del Vaticano II sobre libertad religiosa y el magisterio de los siglos XIX y XX. Para ello intenta un diálogo entre el derecho y la teología. Se detiene en algunos pasajes de Dignitatis humane que desvinculan la libertad religiosa del indiferentismo y apuntan a un concepto de “derecho” distinto del que subyacía a las condenas del magisterio precedente. Después, expone algunos modelos de interpretación de la evolución de la doctrina y estudia en qué medida se pueden aplicar a la libertad religiosa. Concluye que ha habido una seria rectificación, pero la intención fundamental de ambos magisterios coincide.

The author studies the continuity between the magisterium of the Second Vatican Council on religious freedom and the Church’s magisterium in the nineteenth and the twentieth centuries. To this purpose, the article attempts to establish a dialogue between law and theology. It reflects on some passages of Dignitatis humanae that dissociate religious freedom from indifferentism and point to a concept of «law» different from the one that underlies the condemnations of the previous teachings. Afterwards, the article exposes some ways to interpret the evolution of the doctrine and examines the possibility to apply these interpretations to the matter of religious freedom. The article concludes that there has been a serious rectification, but the underlying intentions of both magisterium coincide.
