La obligatoriedad en sentido jurídico y las pretensiones del derecho. Una aproximación desde Joseph Raz y John Finnis

Abstract

¿Pretende el derecho ser moralmente obligatorio? El sentido de la obligatoriedad en el derecho, ¿es el mismo que el sentido de obligatoriedad en el razonamiento moral? El objetivo de este artículo consiste en mostrar las razones que llevan a Raz y a Finnis a identificar un tipo de obligación propiamente jurídico, diferenciado de la obligación en sentido moral, pero en conexión con ella, así como poner de relieve algunas de sus inconsistencias, sobre todo en relación con el carácter excluyente del derecho que defienden y a la naturaleza de la obligatoriedad jurídica que se desprende de dicho carácter excluyente.

Does the law pretend to be morally obligatory? The sense of the obligatoriness in law, is the same as the sense of the obligatoriness in the moral reasoning? The purpose of this article is to show the reasons that lead Raz and Finnis to identify a type of legal obligation that is distinct from the obligation in the moral sense, but in connection with it, and to highlight some of their inconsistencies, especially in relation to the exclusionary character of the law and the nature of the legal obligation that they defend.
