La inspiración tomista del realismo jurídico de Javier Hervada

Abstract

Javier Hervada claimed that his master par excellence was Thomas Aquinas. The article seeks to verify to what extent this applies to the Hervadian conception of classical legal realism, which considers the just thing as the essence of right. To this end, it studies the relevance of St. Thomas both to the event of Hervada’s «enlightenment » on that realism and to the implications of that «enlightenment». In the end, it is specified in what sense we can speak of Hervada’s Thomism. In this sense, the article shows that Hervada is not an author who has analytically dedicated himself to studying the works of Aquinas, but a jurist and philosopher of law who has tuned in to his doctrine, taking it as a starting point for personal elaboration, trying to restore and develop legal realism, through didactic and systematic presentations, while also taking into account the themes of our time, such as human rights. Special use has been made of the sources in which Hervada himself speaks of his scientific work.

Javier Hervada afirmaba que su maestro por antonomasia era Tomás de Aquino. El artículo se propone verificar en qué medida ello se aplica a la concepción hervadiana del realismo jurídico clásico, que considera la cosa justa como esencia del derecho. Con este fin se estudia la relación con Santo Tomás tanto del evento de la «iluminación » de Hervada sobre ese realismo como de las implicaciones de esa «iluminación». Al final se precisa en qué sentido existe un tomismo de Hervada. En este sentido, el artículo muestra que no se trata de un autor que se haya dedicado analíticamente a estudiar las obras del Aquinate, sino de un jurista y filósofo del derecho que ha sintonizado con su doctrina tomándola como punto de partida para una elaboración personal, tratando de repristinar y desarrollar el realismo jurídico, mediante presentaciones didácticas y sistemáticas, y teniendo en cuenta los temas de nuestro tiempo, como los derechos humanos. Se han usado especialmente las fuentes en las que el mismo Hervada habla de su trabajo científico.
