El objetivo de este trabajo es el estudio de la filiación por técnicas de reproducción humana asistida en el Nuevo Código Civil y Comercial Argentino. La tesis de trabajo consistirá en analizar cómo en esta nueva categoría filiatoria, fundada sobre la voluntad procreacional se legisla primordialmente tomando en cuenta las necesidades del adulto que hará uso de las técnicas de reproducción humana asistida, olvidando así los derechos del hijo. Se demostrará como frente a la colisión entre el derecho del adulto a la procreación y el derecho del hijo a la vida, a la identidad y a crecer con un padre y una madre, el derecho otorga primacía a los derechos del adulto.

The objective of this paper is the study of filiation by human assisted reproduction techniques in the new civil and commercial Argentinian code. The thesis statement will mainly consist in analysing how in this new filiation category which is founded in the procreational will, it will be legalised by mainly taking into consideration the necessities of the adult who will make use of the assisted reproduction techniques, forgetting the children’s rights. Facing the collision between the adult´s right to procreation and the right of the children to life, identity and growing up with a father and a mother, the law gives primacy to the adult´s right.
