La libertad, sea para negarla sea para afirmarla, sigue siendo un concepto clave en Derecho penal. Pero sobre la libertad existe una amplia polisemia que dificulta recurrir a ella en la doctrina jurídico-penal. El autor propone dos distinciones: la libertad de la acción tanto en prospectiva como en retrospectiva, y la libertad innata y adquirida. A partir de ahí se describen cuatro facetas de la libertad: antropológica, libre albedrío (volición y voluntariedad) y libertades políticas.

The freedom, be to deny it be to affirm it, it continues being a key concept in Criminal law. But on the freedom there exists a wide polysemy that it impedes to resort to her in the criminal law doctrine. The author proposes two distinctions: the freedom of the action so much in prospective approach as with retrospective one, and the innate and acquired freedom. From there four facets of freedom are described: anthropologic, free will (volition and wilfulness) and liberties.
