Abstract
The African continent definitely had to deal with the issue of human rights at the time decolinisation was on debate. However, it was already known that such step would not be easy since many cultural, economic and social principles on its foundation are not shared with other continents, like Europe. This African reality would be imposed in the different legal instruments adopted in the human rights field. There, it can be clearly seen that African particularities play an essential role in the African Charter on Human and Peoples’ Rights, adopted the 27 of June 1981 in Nairobi, and also in more recent instruments. This explains the institutional and legal complexity in the field, which poses certain problems when trying to determine competence. In any case, it is desirable that step by step this institutional and legal puzzle becomes clearer, this being necessary for coming out of the bushes.
