Abstract
El objeto del trabajo es examinar el papel del derecho a la intimidad en la relación clínica entre el paciente o usuario y los profesionales que le prestan asistencia sanitaria. A tal fin en la primera parte se aborda la evolución del derecho a la intimidad, sus diversas facetas y su relación con el nuevo derecho fundamental a la protección de datos personales, subrayando la complejidad del derecho a la intimidad que sería un reflejo de la complejidad de la dignidad humana y de la existencia humana concreta. Sobre estas bases, en la segunda parte se analizan los aspectos del derecho a la intimidad que están especialmente implicados en la relación clínica: la intimidad corporal y el sentido del pudor del enfermo y el derecho a la confidencialidad del paciente respecto de las informaciones que le afectan y a las que el profesional tiene acceso en la relación clínica. En ese contexto se examina el secreto médico concebido no sólo como un deber moral del facultativo, sino como una obligación jurídica derivada del derecho a la intimidad del paciente, y se analizan sus límites necesarios para armonizar el mencionado derecho con otros.
The purpose of this paper is to examine the role of the right to privacy in the medical relationship among the patient or user and the professionals that provide medical assistance. With this aim, the first part tackles the evolution of the right to privacy, its different angles and its connection with the new fundamental right to personal data protection, underlying the complexity of the right to privacy as a reflection of the intricacy of the human dignity and of the concrete human existence. Standing on this legs, the second part analyses the aspects of the right to privacy especially implied in the medical relationship: the bodily privacy and sense of decency of the patient and the right to confidentiality of the patient regarding the information that affects him or her and to which the professional has access in the medical relationship. In this context the medical secret appears not only as a moral duty to the physician but as a legal obligation derived from the right to privacy of the patient, and its necessary limits to harmonize the aforementioned right with other rights are analyzed.
