Il rapporto tra delitto e peccato nell’attualità del diritto canonico

Abstract

La percepción de la distinción entre delito y pecado se encuentra en la base de la ciencia penal y ha resultado una fatigosa conquista del pensamiento canónico. Tras el Concilio Vaticano II se ha atenuado en las formulaciones doctrinales y en las propuestas legislativas la claridad de esa diferenciación así como la exigencia del castigo, influyendo sobre la hermenéutica del sistema y la conducta de los operadores. La explosión de la justicia penal en los últimos años manifiesta la falacia de aproximaciones antijuridistas y antipenalistas. Para superar los movientos pendulares en el planteameinto eclesial, entre laxismo y justicialismo, entre perdonismo y retribucionismo etc., parece útil recuperar el equilibrio y la serenidad en los presupuestos y en el concreto ejercicio de la potestad coactiva.

The distinction between delict and sin is at the heart of discussions of penal law, and amounts to an especially hard-won achievment in canonical thinking. In post-Vatican II doctrinal definitions and legislative proposals, both the clarity of the distinction and the need to punish have been mitigated, influencing the interpretation of the system and the behavior of the agents involved. The vast expansion of penal justice in recent years has disclosed the fallacy of anti-judicial and anti-penal attitudes. Hence, so as to avoid radical oscaillation in ecclesial contexts between laxity and strict legality, indulgent forgiveness and vengeful retribution, etc., it may be worthwhile to reassert a balanced and calm approach to the principles and practice of coercive power.
