Sobre la Justicia y el Derecho. Principios de la teoría del derecho natural

Abstract

Este trabajo trata de resumir algunos principios de la teoría clásica del derecho natural sobre las nociones básicas de la justicia y del derecho. En primer lugar, trata de la justicia como orden de la sociedad y como virtud. Se refiere después a los diversos significados del derecho, considerado como objeto de la justicia, como derecho subjetivo, como norma o ley, como ciencia y jurisprudencia. A continuación, trata de las relaciones entre derecho natural y derecho positivo. Finalmente, se refiere al significado de la teoría clásica de derecho natural en relación con el positivismo jurídico, así como a la necesidad de repensar continuamente esa teoría para que pueda desempeñar la función que le corresponde en el problema de la fundamentación del derecho.

This paper offers an overview of some of the principles of the classical theory of natural law relating to the fundamental ideas of justice and rights. First, justice is presented as an order of the society and as virtue. Thereafter, the various meanings of right are explored: the object of justice; subjective right; norm or law; knowledge and jurisprudence. The interrelationships between natural law and positive law are then discussed. Finally, the classical theory of natural law is read in relation to legal positivism, and the need to continually renew such theory so as to ensure that it may continue to respond to the problem of grounding rights and the law is considered.
