La formación del vínculo matrimonial de Graciano a Alejandro III: ¿tan sólo una cuestión histórica?

Abstract

Durante el siglo XII, gracias sobre todo al impulso de los estudios teológicos sobre la sacramentalidad del matrimonio y a la composición del Decreto de Graciano, pudo fijarse la doctrina sobre la formación del vínculo matrimonial. La narrativa tradicional ha presentado dicho periodo como una polémica entre dos escuelas netamente diferenciadas (la canónica y la teológica), con dos visiones completamente divergentes de la constitución del vínculo matrimonial (por la consumación los canonistas, por el consentimiento los teólogos). En el presente artículo se pretende profundizar en las fuentes para corregir los aspectos excesivamente simplistas de dicha caracterización y, a la vez, reflexionar sobre las enseñanzas que de dicho periodo histórico puedes extraerse para una mejor presentación de nuestro actual derecho matrimonial canónico.

Due to developments in the theological account of the sacramentality of marriage and the compilation of the Decretum Gratiani, the doctrine concerning the formation of the marriage bond was defined over the course of the 12th century. This period is traditionally seen as marked by the controversy between two radically different schools of thought (the canonical and the theological), based on two completely contrasting views on the formation of the marriage bond (consummation in canon law, consent in theology). The purpose of this paper is to explore the historical sources so as to correct such an overly simplistic explanation and, at the same time, to reflect on ideas dating to that historical period that may shed further light on current canon law in relation to marriage
