La posibilidad de normas dispositivas en el Derecho de la Unión Europea

Abstract

En la actualidad la distinción entre Derecho público y Derecho privado cambia de carácter tras la incorporación a la Unión Europea. Por razones históricas, antes de la integración, los sistemas de Derecho de cada uno de los países tendían hacia la territorialidad y la soberanía estatal, con lo que la combinación entre soberanía y libertad tenía siempre carácter estatalista. A partir del Tratado de la Unión Europea se plantea la interesante cuestión de cómo establecer o construir la concurrencia de ordenamientos jurídicos no en conflicto sino en dimensión supranacional. El reto de abrir un cauce transfronterizo al desarrollo de las instituciones públicas y privadas cuya diferencia no es dialéctica sino inspirada en el mensaje de Europa: la convivencia en justicia y paz.

Nowadays, the distinction between Public Law and Private Law has changed, particularly after the incorporation of the states to the European Union. Before that inclusion, and because of historical reasons, the different legal systems of each country were inclined to territoriality and state sovereignty. Therefore, the combination of sovereignty and freedom always had a statist nature. After the Treaty on European Union, has raised the interesting matter of how to set the rules or parameters for the confluence of legal systems, not in conflict, but in a supranational scope. The challenge of opening a cross-border channel for the development of public and private institutions which difference is inspired in Europe´s message, rather than dialectical: coexistence in justice and peace.
