dc.description.abstract | : A lo largo de la historia, desde las venerabiles domus de beneficencia en el derecho justinianeo, han existido fundaciones canónicas. La figura técnica sobre la que subsistía su subjetividad en el derecho ha variado mucho. Actualmente responden a la figura de universitates rerum(conjuntos de cosas). La noción de universitasha sido constantemente empleada en el derecho, y también la de universitas personarum. La nocion de universitas rerum en cambio no se ha usado con frecuencia. Su origen no es clásico, sino que responde más bien a la tipología clasificatoria de las personas jurídicas (corporaciones/fundaciones) hecha en el siglo XIX en Alemania. Ha mejorado la distinción antigua del CIC de 1917 entre personas jurídicas colegiales y no colegiales. Sigue teniendo sin embargo una utilidad escasa y, como todas las tipologías binarias, es mejorable desde el punto de vista clasificatorio. | es_ES |
dc.description.abstract | Canonical foundations have been in existence throughout history, from the venerabiles domus in Justinian law onwards. The technical structure on which their subjectivity was based has varied widely. At the moment, they are defined as universitates rerum (aggregates of things). The notions of universitas and universitas personarum have been cited constantly in the law. However, the notion of universitas rerum has not been used frequently. Its origin is not classical; rather, it stems from the typology of juridical persons (corporations/foundations) devised in nineteenth-century Germany. It has improved the 1917 CIC distinction between collegial and non-collegial juridical persons. Nevertheless, like all binary typologies, its use is still somewhat limited. | es_ES |
