Una aproximación histórica a la concepción realista del derecho

Abstract

En el centenario del nacimiento de Álvaro D’Ors resulta oportuno tratar de contextualizar su visión acerca del derecho. En este sentido, él mismo se define como “realista”, frente al idealismo y al positivismo jurídico. La concepción realista del derecho parte de la consideración de éste como el objeto de la virtud de la justicia, por lo que el derecho se identifica con lo justo, con la cosa concreta debida a alguien. Los orígenes de esta mentalidad se sitúan en la obra aristotélica y, en concreto, en el Libro V de la Ética Nicomáquea. El propósito de estas líneas es situar históricamente el origen de esta consideración del derecho que tanto ha influido en la Ciencia jurídica.

In the centenary of Álvaro D’Ors’s birth, it is appropriate trying to contextualize his vision about the law. Accordingly, he describes himself as "realistic" against the idealism and legal positivism. The realistic conception of law parts from the consideration of it as the object of the virtue of justice, therefore that law is identified with the fair; with the concrete thing that someone must to someone. The inception of this mentality comes from the Aristotelian work and, especially, in Book V of the Nicomachean Ethics. The purpose of these lines is to stablish the historical origins of this consideration of the law that has influenced so much in the legal science.
