Problemas que una nota esencial de los derechos humanos continúa planteando a la Filosofía del Derecho

Abstract

El objeto del trabajo consiste en poner de relieve la vigencia de un argumento empleado por Javier Hervada en un antiguo trabajo suyo. Según este autor, el hecho de que las declaraciones sobre derechos humanos se refieran a los derechos humanos como derechos “reconocidos” tiene un impacto relevante sobre la Filosofía del Derecho. Luego de sintetizar las ideas de Hervada, se procurará extenderlas a un ámbito que sólo está implícito en su argumento: el de la teoría general de los derechos humanos.

The aim of this paper is to highlight the validity of an argument employed by Javier Hervada in one of his papers. According to him, the fact that human rights declarations relating to human rights as rights "recognized" has a significant impact on the Philosophy of Law. After synthesizing the ideas of Hervada, I will seek to extend to an area that is only implicit in his argument: the general theory of human rights.
