Los límites de lo normativo

Abstract

Los enunciados del Derecho penal (legislación, jurisprudencia y dogmática) presentan carácter normativo. Con el fin de evitar la arbitrariedad de los enunciados que empleamos (el riesgo de constructivismo), es preciso establecer ciertos límites y condicionamientos. Estos límites no son de carácter empírico, sino normativo. Concretamente, se propone que dichos límites provienen de la coherencia lógica, la consistencia valorativa y la capacidad performativa de los enunciados. Establecidos estos límites, se procede a ejemplificar cómo se presentan en diversas operaciones de la legislación, aplicación del Derecho y la dogmática.

The statements of criminal law (statutes, courts decisions and dogmatics) have a normative character. In order to avoid the arbitrariness (the risk of constructivism) of these statements, it is necessary to establish certain limits and conditions. These limits have not empirical, but normative character. Specifically, here I suggest that these limits come from the logical coherence, the value consistency and the performative capacity of the statements. Having defined these limits, I aim to exemplify how they are displayed in different operations of legislation, application of law and dogmatics.

Die Formulierungen des Strafrechts (Gesetzgebung, Rechtsprechung und Dogmatik) sind normativer Natur. Um die Beliebigkeit (das Risiko des Konstruktivismus) bei diesen Aussagen zu vermeiden, ist es notwendig, gewisse Grenzen und Bedingungen festzulegen. Diese Grenzen sind nicht empirisch, sondern normativ. Konkret wird vorgeschlagen, dass sich diese Grenzen aus der logischen Kohärenz, der Wertekonsistenz und der Leistungsfähigkeit der Aussagen ergeben. Sobald diese Grenzen festgelegt sind, wird beispielhaft dargestellt, wie sie in verschiedenen Operationen der Gesetzgebung, der Rechtsanwendung und der Dogmatik zum Ausdruck kommen
