    This article aims to analyze the regulation of the rights of the citizens of the European Union and the United Kingdom after the withdrawal of this Member State from the Union, scheduled for March 30, 2019. To this end, it examines the most relevant provisions of the withdrawal agreement made public on November 14, 2018 as well as the situation in which the aforementioned rights would be in a no-deal scenario.
  • Challenging the transitional justice paradigm: addressing ESRs violations in transitional justice processes

    The economic and social dimension of transitional justice has been largely ignored in favour of traditional emphasis on violations of civil and political rights. While early transitional justice processes mainly focused on criminal prosecutions for bodily integrity violations, socioeconomic issues, including economica and social rights (herein ESRs) violations, were seen just as part of background. However, scholarship and practitioners are increasingly calling to include ESRs violations in transitional justice processes. Indeed, economic and social conditions are frequently linked to human rights abuses, often constituting a cause, means or consequence of conflict and authoritarianism. Including the assessment of ESRs violations as an issue for transitional justice might serve the purpose of establishing a more comprehensive understanding of the root causes of past human rights violations as well as to facilitate the pathway to achieve a sustainable peace.

    Entre el libre comercio y el proteccionismo. Impacto de los obstáculos sobre la equidad en el comercio en el marco de la Agenda 2030

    The objective of the present article, is to analyze the current situation of free trade, the imposition of barriers, both tariff and non-tariff, and its incidence for the equity of international trade. This analysis deals in particular with the evolution of free trade and the different restrictions and obstacles that countries have imposed, seeking, on the one hand, the protection of their national industry, the defense of their own interests and, on the other hand, the search for commercial opening and trade facilitation through the general liberalization of barriers. Together with the above, a review is made of the objectives set by the international community for the coming years, taking as reference the horizon of 2030, within the framework of the Sustainable Development Goals.

    El fracaso internacional del independentismo catalán: causas jurídicas y políticas

    The unilateral secessionist process of Catalonia, promoted by the autonomic powers and supported by a part of society, was developed during 2017 following a political strategy that tried to repeat the model of unilateral independence declaration of Kosovo, in which the support and international recognition were the key to its success. However, the Catalan international initiative made important legal and political mistakes that were decisive for its failure. In the legal field and with the purpose of avoiding the Spanish system, it wanted to impose an interpretation of self-determination right opposed to establish by the international norms and the practice of States. In international politics, its foreign projection was based on a combination of media propaganda and public diplomacy to pressure the governments of great powers and European institutions, devaluing the importance of their commitments and interests established with the Spanish State. Finally, an attempt was made to base internationally the secessionist aspiration by resorting to a democratic legitimacy that political reality of Catalonia does not endorse electorally. The result has been a failure of secessionist process that has generated an increase in social tension and political instability in Spain and Catalonia, thus delaying the solution of a political problem that cannot be ignored although it still cannot be resolved.

    ¿Hacia una responsabilidad objetiva del Estado que «no puede» combatir el terrorismo internacional?

    Operation Inherent resolve against ISIL in Syria has revitalised the debate on the legitimacy of the «unwilling or unable» State theory. Starting from 9/11 terrorist attacks, States’ practice has shown a growing tendency to expand the right of self-defence of Article 51 of the U.N: Charter. Thus, the present study primarily revises the first extension of self-defence that took place after 9/11 allowing its invocation against the State that shelters a terrorist group. Moreover, it analyses a second expansion of the right of self-defence based on the «unwilling or unable» theory which seems to trespass into States’ strict liability for not preventing terrorists attacks originating from their territory.

    La crisis catalana y el desgobierno de los gobiernos de España

    La denominada crisis catalana ha puesto a España en el tapiz de la actualidad internacional al abrirse una crisis de identidad nunca conocida desde la Guerra Civil española. Cabe preguntarse cómo esto ha podido ocurrir en uno de los Estados más antiguos de Europa, y en un momento crítico para la Unión Europea, aunque, en nuestra opinión, hay que reconocer que en esta crisis una buena parte de la responsabilidad incumbe a los distintos Gobiernos de España, sobre todo a los dos últimos, es decir al Gobierno de José Luís Rodríguez Zapatero, y al de Mariano Rajoy. Si el primero abrió la caja de pandora al apoyar abiertamente la reforma del Estatuto catalán en 2006, en parte después anulada por el Tribunal Constitucional, el segundo ha hecho prueba de una ignominiosa pusilanimidad, permitiendo que el asunto se le fuera de las manos. Así pues, ni uno ni otro han estado a la altura de las circunstancias...

    EU Common Foreign and Security Policy and Bosnia and Herzegovina

    The beginning of modern history and the subsequent war in Bosnia and Herzegovina coincide with the institutional beginnings of the European Union common foreign and security policy. At that time, Europe did not have a single position, nor could it have achieved a political consensus on any issue. In addition, it lacked appropriate instruments, as well as readiness and willingness to actively engage to put an end to war in BiH. The war in BiH was stopped, however, thanks to the efforts of the United States. This was a crucial moment for Europe to modify its common foreign and security policy. The European Union has passed a thorny path of establishing common foreign and security policy. On this path, however, the EU has experienced some progress and achieved good results, although not sufficient, just as BiH has made some progress in reforms. In order for BiH to joint the family of modern democratic countries, it will need a stronger engagement of the European Union and its more decisive common foreign and security policy, because only together we can cope with global challenges. Peace and prosperity in Bosnia and Herzegovina will also help build free and stable Europe.

    Two are the theses of this Study: one, the International Law inforce not guarantee, nor in its theory nor in its practice, the «right to decide» that the defenders os de independence process allege; and two, this process is contrary to the Spanish Constitution in force. In sum, Democracy can not come into conflict with the Rule of Law and still less prevail over the same.
