El Derecho internacional de las migraciones: entre la crisis y la renovación
(Servicio de Publicaciones de la Universidad de Navarra, 2019) Juste-Ruiz, J. (José)
The international migration regime currently in force is manifestly insufficient for the regulation and governance of migration flows. The irreducible collision between the right of persons to leave their country and the right of States to reject the admission of migrants in its territory has led, in practice, to a vicious circle resulting in an increase in irregular migration and the multiplication of dramatic situations that hurt humanitarian feelings. In view of this situation, the United Nations promoted the adoption in January of 2019 of two instruments seeking to establish a new framework for international cooperation in this field: a Global Compact on Refugees and a Global Compact on Safe, Orderly and Regular Migration. However, as general consensus on the new instruments has not been reach it seems difficult to foresee a prompt solution of outstanding issues.

El accidente del buque "Prestige" en el Tribunal Europeo de Derechos Humanos
(Servicio de Publicaciones de la Universidad de Navarra, 2019) Hinojo-Rojas, M. (Manuel)
The accident of the oil tanker Prestige off the coast of Galicia en 2002 caused an ecological disaster and other damages, because the contents of its tanks fell into the Atlantic Ocean. After the arrest of Mr. Mangouras, his captain, and the imposition of a bail of three million euros by the Spanish Courts to release him, given the evidence of the commission of certain crimes, Mr. Mangouras (a Greek national) took the matter before the European Court of Human Rights considering that the amount of the same was excessive and violated the European Convention of Human Rights. The work analyzes the judicial iter of the matter and the consequences that for its author are extracted from the pronouncement of the Strasbourg Court.
