El accidente del buque "Prestige" en el Tribunal Europeo de Derechos Humanos

Abstract

The accident of the oil tanker <i>Prestige</i> off the coast of Galicia en 2002 caused an ecological disaster and other damages, because the contents of its tanks fell into the Atlantic Ocean. After the arrest of Mr. Mangouras, his captain, and the imposition of a bail of three million euros by the Spanish Courts to release him, given the evidence of the commission of certain crimes, Mr. Mangouras (a Greek national) took the matter before the European Court of Human Rights considering that the amount of the same was excessive and violated the European Convention of Human Rights. The work analyzes the judicial <i>iter</i> of the matter and the consequences that for its author are extracted from the pronouncement of the Strasbourg Court.

El accidente del petrolero <i>Prestige</i> frente a las costas de Galicia en 2002 provocó un desastre ecológico y otros daños, porque el contenido de sus tanques cayó al Océano Atlántico. Tras la detención del señor Mangouras, su capitán, y la imposición en un primer momento de una fianza de tres millones de euros por los tribunales españoles para dejarlo en libertad, dadas las evidencias de haberse cometido ciertos delitos, el señor Mangouras (de nacionalidad griega) llevó el asunto ante el Tribunal Europeo de Derechos Humanos considerando que la cuantía de la misma era excesiva y que se violaba el Convenio Europeo de Derechos Humanos. En el trabajo se analiza el <i>iter</i> judicial del asunto y se extraen las consecuencias que para su autor tiene el pronunciamiento del Tribunal de Estrasburgo.
