El arbitraje internacional en la obra de Francisco Suárez: A propósito de una antigua polémica

Abstract

En este artículo se retoma una antigua polémica acerca de la doctrina del derecho a la guerra y el arbitraje internacional que tuvo lugar a mitad del siglo XX entre Viñas, Hellín y Pereña. Las posturas oscilan entre la interpretación subjetivista y voluntarista de Viñas y Pereña (atendiendo al probabilismo adoptado por Suárez) y la interpretación de Hellín quien opina que Suárez tan solo recoge las doctrinas escolásticas del momento (también entre los dominicos). La polémica tiene actualidad pues todavía hoy en día es posible interpretar a Suárez en clave absolutista o en clave democrática. Al final del artículo se sugiere una hermenéutica más centrada en el momento histórico en que surgieron esas doctrinas que en nuestras categorías contemporáneas.

This article focuses on the old controversy between Viñas, Hellín and Pereña regarding the right to war doctrine and the international arbitration halfway the XX century. Viñas and Pereña have a subjective and voluntarist interpretation which attends to Suárez’s probabilism. Differently, Hellín believes that Suárez only gathers the scholastic doctrines of those times, similarly to the Dominicans. The controversy goes on still nowadays since Suárez’s tone can be interpreted as absolutist or democratic yet. At the end of the article, a more historically centered hermeneutic is proposed, which differs from our contemporary categories.
