Inducción al suicidio y solidaridad intersubjetiva: fundamentos para una reinterpretación del art. 143.1 CP

Abstract

Este trabajo tiene por objeto el análisis de un tipo delictivo concreto como es el delito de inducción al suicidio del art. 143.1 CP. Se parte de identificar una realidad empírica del suicidio distinta a la manejada habitualmente para hablar de estos supuestos, no centrada tanto en el problema de consentimiento del sujeto titular de la vida, sino en la necesidad de proteger a un grupo especialmente vulnerable y débil: aquellas personas que puedan tener ideaciones suicidas. Esta realidad plantea la valoración de estas conductas, no desde una perspectiva del neminem laedere, sino de infracción de deberes positivos, en clave de solidaridad intersubjetiva. En el trabajo se propone una reinterpretación del delito de inducción al suicidio, no como una forma de participación en un suicidio, visto como el hecho principal, sino como una conducta propia de autoría. Esto lleva a proponer una interpretación del tipo objetivo en cuanto al riesgo típicamente relevante en clave de imputación objetiva, así como el análisis de otros elementos presentes en el tipo penal

This paper aims to analyse a specific actus reus, such as the crime of inducement to commit suicide of sec. 143.1 (Spaniard Penal Code). It starts from identifying an empirical reality of suicide different from the one usually considered about these assumptions, not focused so much on the problem of the consent of the life’s owner but on the need to protect a particularly vulnerable and weak group: those People who may have suicidal ideation. This reality raises the assessment of these behaviours, not from a neminem leadere perspective, but from a violation of positive duties, in terms of intersubjective solidarity. Hence, a reinterpretation of the crime of inducement to suicide is proposed here. And not as a form of participation in a suicide (where the act of self-killing is seen as the significant risk), but as an actus reus of authorship. This leads to submitting an interpretation of the actus reus (i.e., objective typus) in terms of acurate liability of the typically–relevant–risk and the analysis of other elements in this criminal structure.
