De campanarios y relojes. El derecho y la jurisprudencia frente a un agresor acústico menor

Abstract

El presente artículo aborda la contaminación acústica desde una perspectiva singular, el sonido ancestral de los campanarios que para algunos es un bien de interés cultural inmaterial y para ciertos vecinos perturba su derecho al descanso y a la inviolabilidad domiciliaria. A lo largo de este breve trabajo se exponen posibles soluciones, la regulación actual y el tratamiento de los distintos órdenes jurisdiccionales ante las demandas frente a este «nuevo» agresor acústico menor.

This paper examines the main conflicts that have occurred with noise pollution from a singular perspective, the ancestral sound of bell towers that for some people are a thing of cultural interest and for some neighbors it disturbs their right to rest and domicile inviolability. This work explains the current regulation and the treatment of the different jurisdictional orders in relation to the demands against this «new» minor noise pollutant.
